1. Agreement
These Terms of Service ("Terms") govern your access to and use of yggdrasilcards.com (the "Site") and any products or services offered through it (together, the "Service"), operated by Yggdrasil Cards LLC, an Illinois limited liability company ("Yggdrasil Cards," "we," "our," or "us"). By visiting the Site or purchasing something from us, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Who we are; no affiliation
Yggdrasil Cards is an independent retailer of trading cards and collectibles. We are not affiliated with, endorsed by, or sponsored by The Pokemon Company, Nintendo, Bandai, Toei Animation, Shueisha, Konami, PSA, or any other manufacturer or rights holder. All product names, logos, and trademarks belong to their respective owners and are used only for descriptive, nominative purposes.
3. Where we sell
We sell sealed product and singles through third-party marketplaces (such as TCGplayer and eBay) and may also offer products for sale directly through the Site. Purchases completed on a third-party marketplace are governed by that marketplace's terms of service, payment systems, and buyer protections. Purchases made directly from us, whether through the Site, by email, or in person, are governed by these Terms.
4. Online store terms
By using the Site you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents to use the Site. You may not use our products or the Service for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including copyright laws) in the course of using the Service. You must not transmit any worms, viruses, or code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of the Service to you.
5. General conditions
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including payment card information) may be transferred unencrypted and involve transmissions over various networks; payment card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.
6. Products
Our products are collectibles. The following terms apply to all direct sales:
- Condition and grading. We describe the condition of singles in good faith using a four-part assessment (centering, corners, edges, surface) and disclose professional grades (such as PSA) where applicable, including certification numbers. Condition descriptions are opinions rendered with care, not guarantees that any grading service would assign a particular grade.
- Market value. Trading card market prices fluctuate. We make no representation or warranty about the future value of any product, and nothing on the Site is investment advice.
- Images. We make every effort to display product images accurately, but we cannot guarantee that your screen's display of any color or detail will be accurate.
- Availability. Products may be available exclusively online and in limited quantities. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, to limit the quantities of any products we offer, and to discontinue any product at any time. All descriptions and pricing are subject to change at any time without notice.
7. Prices and modifications to the service
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part of it) without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
8. Billing and order information
We reserve the right to refuse or cancel any order you place with us, and to limit or cancel quantities purchased per person, per household, or per order, including orders that appear to be placed by dealers or resellers. If we change or cancel an order we will attempt to notify you using the contact information provided at the time of the order. You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update it so that we can complete your transactions and contact you as needed. We reserve the right to correct any errors, inaccuracies, or omissions on the Site and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.
9. Payment
Direct payments are processed by third-party payment processors. We do not receive or store your full payment card number. Your use of a payment processor is subject to its own terms and privacy policy.
10. Shipping and risk of loss
We ship to the address you provide at checkout or by written instruction. Shipped items are packaged with care appropriate to collectibles. Risk of loss and title pass to you upon our delivery of the item to the carrier, except where applicable law provides otherwise. Tracking is provided where available, and high-value shipments may require signature on delivery.
11. Returns and refunds
For purchases made directly from us:
- Not as described or damaged in transit. If an item arrives materially different from its description or damaged, contact us within 5 days of delivery with photos and we will make it right with a replacement, repair of the issue, or refund.
- Sealed product. Sealed product is returnable only with the factory seal intact and unopened. Once opened, sealed product cannot be returned.
- Graded items. Professionally graded items (slabs) are sold as the grade stated on the label and are returnable only if the item received does not match the listing's certification number.
- All other direct sales are final. Purchases made on a third-party marketplace follow that marketplace's return policy.
12. Accuracy of site information
We are not responsible if information made available on the Site is not accurate, complete, or current. The material on the Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on the Site is at your own risk.
13. Third-party links and tools
The Site may include links to third-party websites (including marketplaces and streaming platforms) and may provide access to third-party tools, all "as is" and "as available" without warranties of any kind. We are not responsible for the content or accuracy of third-party websites or for any harm or damages related to your dealings with them. Review the third party's policies before you transact with them.
14. User submissions
If you send us comments, suggestions, or other materials, you agree that we may, at any time and without restriction or compensation, use them in any medium. We are under no obligation to maintain submissions in confidence. You agree your submissions will not violate any right of any third party and will not contain unlawful or abusive material or any malware.
15. Live streams
We open sealed product live on stream. Results shown on any stream are the actual results of those specific openings and are not representative of, and do not guarantee, the contents of any product we sell. Purchasing from us does not require watching, participating in, or interacting with any stream.
16. Personal information
Your submission of personal information through the Site is governed by our Privacy Policy.
17. Prohibited uses
In addition to other prohibitions in these Terms, you are prohibited from using the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
18. Disclaimer of warranties; limitation of liability
We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free. The Service and all products delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Yggdrasil Cards LLC, our members, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any products procured using the Service. Our total liability for any claim shall not exceed the amount you paid us for the product or service giving rise to the claim. Because some jurisdictions do not allow the exclusion or limitation of certain damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Yggdrasil Cards LLC and our members, officers, employees, affiliates, agents, contractors, and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
20. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
21. Termination
The obligations and liabilities of the parties incurred prior to the termination date survive termination. These Terms are effective unless and until terminated by you or us. We may terminate these Terms at any time without notice if in our sole judgment you fail to comply with any term, and you will remain liable for all amounts due up to and including the date of termination.
22. Entire agreement
These Terms and any policies posted by us on the Site constitute the entire agreement between you and us and supersede any prior agreements or communications. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
23. Governing law
These Terms and any separate agreements whereby we provide you the Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Venue for any dispute shall lie in the state or federal courts located in Cook County, Illinois.
24. Changes to these terms
You can review the most current version of the Terms at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to the Site. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
